General terms and conditions for asbestos and hazardous material investigations.
1. Provider and scope
These general terms and conditions concern investigation services provided by Hamidreza Arghiyani, SchadstoffCheck, Lohstr. 187, 47798 Krefeld, to private and business clients, insofar as the terms are validly agreed before the contract is concluded. Individual agreements take precedence.
2. Enquiries and contract formation
The information on the website and the creation or sending of a project enquiry do not constitute a paid instruction. Once the project has been clarified, the scope of services, fees and other contractual terms are offered and agreed with the client. A contract is formed by offer and acceptance.
Agreements are documented appropriately, for example by email. Individual agreements take precedence even when made orally. Merely viewing these terms does not replace their valid incorporation into the particular contract.
3. Scope of services
The agreed assignment may include a site visit, investigation planning, sampling, laboratory analysis, professional assessment and the final report. The specifically agreed building and material areas, investigation objectives, analytical methods and report contents determine the scope.
The report relates findings to the materials investigated, the agreed scope and the identifiable limits of the investigation. Any need to investigate additional areas or substances is agreed separately. Remediation or disposal work is included only where expressly agreed.
4. Documents, access and sampling
The client supplies the information available to them that is needed for the investigation and identifies known hazards, earlier findings or special access conditions. The client enables the agreed access and arranges any necessary consent from persons authorised to grant it.
The areas and extent of any necessary disturbance of materials for sampling are agreed in advance. If safety or access questions remain unresolved, the next steps are agreed together.
5. Fees and additional services
Fees are based on the agreed quotation. It specifies the total price or calculation basis and, where applicable, separately charged travel, sampling, analysis and reporting. Prices quoted to consumers include any applicable VAT.
Any extension to the scope and resulting additional costs are agreed before the work is carried out. Due dates and payment terms are governed by the individual agreement and statutory provisions.
6. Dates and report
Dates for site visits, investigations and reporting are agreed for the assignment. Foreseeable delays are communicated and the next steps are agreed. The report is delivered in the agreed format.
7. Rights concerning defects and liability
Statutory provisions apply to rights concerning defects, liability and limitation periods. These terms do not limit statutory liability or consumers' statutory rights.
8. Data protection
Information about processing personal data during website visits, contact and assignments is available in the Privacy policy.
9. Consumers' right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts and contracts concluded off business premises. The following information applies to investigation service contracts for which such a right exists.
Starting work before the withdrawal period expires is agreed only at the consumer's express request and in accordance with statutory requirements. For paid services, the right of withdrawal expires upon full performance only if the statutory conditions are met, particularly the consumer's required express consent and acknowledgement. For contracts concluded off business premises, the necessary consent is provided on a durable medium.
